As a legal researcher employed by a local contractor, you have been asked to analyze the endorsement of a political candidate. The political candidate in question is anti-union and holds very conservative beliefs. Of course, this scenario poses a dilemma for the business, who is the contractor’s client. Although the politician is very pro-business and the business stands to profit substantially from the policies that would be implemented by the politician, these beliefs also stand to alienate customers of the business because of the politician’s stances. Additionally, there are rumblings of dissension among some employees and the desire to form a union. Of course, this does concern the CEO and the board of directors.
As a result, you are directed to research the legislation surrounding the free speech of businesses and the legislation surrounding the formation of unions and business rights. Now, the corporate attorney has asked you to create a memo that details the legislation that you have located. Additionally, you are asked to develop recommendations regarding the affiliation of the business with the politician and the possible actions that the business could take to prevent the formation of a union. The memo should detail those
specific recommendations.
The memo should be at least 700 words in length in business memo format (not counting header information). Please use Bluebook citations. Make sure that you address all aspects covered in the directives. Be sure to maintain professional writing style since this is a business correspondence.
